Terms of Service - HIROZZ

Welcome, HIROZZ.

HIROZZ is more than just a mobile game – it’s an adventure waiting for you to discover. Created by PLETORY, HIROZZ offers you an immersive gaming experience designed to challenge, entertain, and captivate players worldwide.

These Terms of Service (« Terms ») create a legal agreement between you and PLETORY regarding your use of HIROZZ, including our mobile application, website, and any related services (collectively referred to as the « Service »). By downloading, installing, accessing, or playing HIROZZ, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy.

If you do not agree with any part of these Terms, you must not use HIROZZ. Your continued use of our Service constitutes ongoing acceptance of these Terms, including any future modifications we may make.

Your License to Use HIROZZ

We grant you a limited, non-exclusive, non-transferable, and revocable license to use our Service subject to these Terms, our Privacy Policy, and other policies and applicable law.

Downloads and Software Updates

When you create your HIROZZ account or start playing, you agree that the information you provide is accurate and complete. We may deny you access to the Service if we learn that the information you provided is inaccurate. Using HIROZZ requires that we first download software to your mobile phone, tablet or other device. You agree that we may automatically update this software and that these Terms and our policies apply to all updates.

Age and Legal Capacity

You represent that you are at least 13 years old and have the legal capacity to enter into the agreement set forth in these Terms. No one under the age of 13 may use or access HIROZZ. You may not use HIROZZ if you do not have the legal capacity to enter into contracts or if doing so would be prohibited under French law. If you are a resident of the European Economic Area (« EEA »), you may only use HIROZZ if you have reached the age at which you can consent to data processing under the laws of your country or if we have verifiable parental consent for your use of HIROZZ.

Your Responsibility for Your Account

You are also responsible for the activities that occur on your HIROZZ account. We recommend that you protect your account with a strong password and do not share it with others. You agree to promptly notify us of any unauthorized access or use of your account or other security breaches. We reserve the right at our sole discretion to restrict or terminate your access to your account for any reason, including but not limited to violations of these Terms or other policies.

Your Use of HIROZZ

You agree to use HIROZZ only for lawful purposes and to comply with all applicable laws and regulations. You may not use HIROZZ for illegal activities or engage in behaviors that violate applicable laws or regulations. Specifically, you agree not to:

  • Use cheats, exploits, automation software, bots, hacks, mods or any unauthorized third-party software designed to modify or interfere with the Service

  • Attempt to gain unauthorized access to the Service, accounts registered to others, or the computers, servers, or networks connected to the Service

  • Engage in any activity that disrupts or interferes with the Service or servers or networks connected to the Service

  • Reverse engineer, decompile, disassemble, decipher or otherwise attempt to derive the source code for any underlying software or other intellectual property used to provide the Service

  • Sell, transfer, or attempt to sell or transfer your account, virtual items, or any other game assets for real money or other consideration outside of the game

If you violate these Terms or other policies of HIROZZ, we may restrict or terminate your account and/or take legal action against you.

Your Interactions with Other Users

HIROZZ strives to create a safe and enjoyable gaming environment for all players. However, we cannot guarantee that all users on HIROZZ are honest and trustworthy. You are solely responsible for your interactions with other users of HIROZZ. We recommend that you exercise caution and follow our community guidelines and safety tips.

Game Content and Virtual Items

HIROZZ may include virtual items, currencies, or other digital goods that can be earned through gameplay or purchased. You acknowledge and agree that:

  • Virtual items have no real-world value and cannot be exchanged for real money

  • We may modify, suspend, or terminate virtual items at any time

  • Virtual items are non-transferable except through gameplay features we specifically enable

  • Upon termination of your account or the Service, you will lose access to all virtual items

  • We are not liable for any loss of virtual items due to account termination, technical issues, or service discontinuation

Your Complaints

We take the rights of others seriously and encourage you to contact us if you believe that content on HIROZZ violates your rights or if you encounter inappropriate behavior from other players. We will carefully review any legal complaints and take appropriate action if necessary.

Termination

We may suspend or terminate your license to use HIROZZ at any time and for any reason. In general, we will provide notice and the reason for termination or suspension. However, our termination or suspension may be immediate and without notice if we, in our sole discretion, believe that you have committed a serious violation of these Terms or our policies.

Disclaimer of Warranties and Limitation of Liability

HIROZZ is provided « as is » and « as available, » without express or implied warranties of any kind. We expressly disclaim all warranties and conditions of any kind, including but not limited to implied warranties and conditions of merchantability, fitness for a particular purpose, and non-infringement.

We do not guarantee that the Service will be uninterrupted, secure, or error-free, or that defects will be corrected. HIROZZ assumes no responsibility and shall have no liability for any content that you or any other person or third party posts or sends using our Service. You understand and agree that you may be exposed to content that is inaccurate, offensive, indecent, abusive, inappropriate for children, or otherwise unsuitable for your purpose.

To the fullest extent permitted by law, PLETORY shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, use, goodwill, or other intangible losses, resulting from your use of the Service.

In-App Purchases and Subscriptions

In-App Purchases

HIROZZ may offer virtual items, premium content, or other digital goods for purchase using real money. All purchases are final and non-refundable unless otherwise required by applicable law. Prices for in-app purchases may vary by region and are subject to change without notice.

Automatic Renewal and Cancellation (if applicable)

If HIROZZ offers subscription services for premium features, your subscription will automatically renew until you cancel, and you will automatically be charged the associated fee (plus any applicable taxes) until you cancel. To see your next renewal date and current fee, visit your mobile device’s account settings, or the Subscriptions tab that is available through the Apple App Store or Google Play Store.

You must cancel your subscription at least 24 hours before the end of your current billing period to avoid being charged for the next billing period. After cancellation, you will have access to your subscription through the last day of your current billing period, at which point your subscription (and access to your subscription features) will be discontinued. You may cancel your subscription any time through your App Store or Google Play Store.

Paying For Your Purchases

Payments for your purchases are processed via your App Provider (Apple App Store or Google Play Store) and you will need to provide your App Provider with your payment information. You are responsible for maintaining accurate and up-to-date payment information. If a payment is unsuccessful, we may suspend your access to the relevant premium features until you provide a valid payment method. PLETORY is not responsible if your subscription fails to renew due to invalid payment information.

Refunds

Refund requests are handled by your App Provider, not PLETORY. To request a refund, you should follow your App Provider’s refund procedures. PLETORY does not offer refunds for your purchases unless required by applicable law. If you cancel a subscription, we will not issue you a refund or credit for any partial-period access to your subscription.

Changes to Purchases and Features

We reserve the right to change or discontinue premium features, subscription plans, terms, or pricing at any time. PLETORY is not responsible for any damage or loss caused by failures or delays of premium features or subscription services.

Intellectual Property

PLETORY owns and retains all rights, title, and interest in and to HIROZZ and all related intellectual property. This includes, but is not limited to:

  • The HIROZZ name and trademark – The game title « HIROZZ » is a registered trademark of PLETORY

  • HIROZZ logo and visual identity – All logos, icons, and branding elements associated with HIROZZ

  • Character designs and artwork – All original characters, their visual designs, animations, and artistic representations

  • Game assets – All graphics, animations, sound effects, music, user interface elements, and visual effects

  • Source code and technology – All software, algorithms, and technical implementations

  • Game mechanics and concepts – Original gameplay systems, rules, and interactive elements

These elements are protected by French and international copyright, trademark, patent, trade secret, and other intellectual property laws. You are prohibited from:

  • Using the HIROZZ name, logo, or any branding elements for commercial purposes

  • Copying, reproducing, or creating derivative works of our character designs

  • Reverse engineering or attempting to extract game assets

  • Creating unauthorized merchandise featuring HIROZZ characters or branding

  • Using our intellectual property in other games, applications, or commercial projects

Any unauthorized use of PLETORY’s intellectual property may result in immediate account termination and legal action.

General Provisions

Assignment

These Terms and all rights and licenses granted herein may not be transferred or assigned by you, but may be transferred by PLETORY without restriction. Any attempted transfer or assignment in violation of these Terms is null and void.

Severability

If any provision of these Terms is unlawful, void, or for any reason unenforceable, then that provision shall be deemed severable from these Terms and shall not affect the validity and enforceability of any remaining provisions. These Terms, together with our Privacy Policy and any additional agreements you enter into with PLETORY.

No Waiver

No waiver of any provision of these Terms shall be deemed a further or continuing waiver of such provision or any other provision, and PLETORY’s failure to assert any right or provision under these Terms shall not constitute a waiver of such right or provision.

Governing Law

These Terms shall be governed by and construed in accordance with the laws of France, without regard to its conflict of law provisions. Any disputes arising under or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of Paris, France.

Email Marketing and Communications

By downloading and using HIROZZ, you agree to receive emails from PLETORY regarding updates, promotions, and important information related to the HIROZZ game. These emails may include news about new features, exclusive offers, game updates, events, and personalized recommendations to enhance your gaming experience.

We respect your privacy and ensure that your email address is not shared with third parties for marketing purposes without your explicit consent. You can opt out of marketing emails at any time by clicking the unsubscribe link in any email or adjusting your preferences in the HIROZZ game settings.

Please note that even if you opt out of promotional emails, we may still send you essential transactional or service-related emails, such as account verification, security updates, and critical notifications about your use of HIROZZ. By continuing to use our services, you acknowledge and accept these terms regarding email communication.

Push Notifications

HIROZZ may send you push notifications to enhance your gaming experience, including notifications about game events, achievements, daily rewards, or when friends are online. You can manage your notification preferences through your device settings or within the HIROZZ app settings.

Updates to Terms

We may update these Terms from time to time. When we make changes, we will post the updated Terms in the game and update the effective date. Your continued use of HIROZZ after the changes become effective constitutes your acceptance of the new Terms.

Parties

These Terms are a contract between you and PLETORY. PLETORY is the company that owns and operates HIROZZ.
